Kimmy Web Studio is a web design studio owned and operated by Kim Sitthisack, based in Rochester, New York. We provide custom website design services, premium website templates, and digital add-on products for service-based businesses. These Terms govern your use of our website at kimmywebstudio.com and any services or products purchased through it.
2. Acceptance of Terms
By using this website or engaging our services, you confirm that you are at least 18 years of age, have the legal authority to enter into a binding agreement, and agree to these Terms in full. If you do not agree, you must discontinue use of this website and our services immediately.
3. Services Offered
Kimmy Web Studio offers the following:
— Custom Website Design: Done-for-you Wix website builds tailored to your business
— Premium Templates: Pre-designed Wix website templates available for individual purchase ($250–$397 each)
— Done-For-You Add-Ons: Standalone digital products such as the QR Contact Card ($25) and other service enhancements
— Website Maintenance Memberships: Ongoing support and upkeep packages
All services are subject to separate project agreements, invoices, or product terms provided at time of purchase. These Terms apply in addition to any such agreements.
4. Payments & Refund Policy
Custom Services: A deposit is required to reserve your project date. Deposits are non-refundable once work has commenced. Remaining balances are due according to the payment schedule outlined in your project agreement.
Digital Templates & Add-Ons: All digital product sales are final. Due to the nature of digital goods — which are delivered instantly and cannot be returned — we do not offer refunds on templates or downloadable products. Please review all product descriptions carefully before purchasing.
Disputes: If you believe a charge was made in error, contact us within 7 days of the transaction at the contact information in Section 12.
5. Intellectual Property
Our Content: All content on this website — including text, graphics, logos, branding, design elements, and template code — is the intellectual property of Kimmy Web Studio and is protected by applicable copyright and trademark laws. You may not reproduce, redistribute, resell, or repurpose any part of this website or its content without prior written permission.
Templates: Upon purchase of a template, you are granted a single-use, non-transferable license to use the template for one (1) website only. You may not resell, share, sublicense, or distribute the template to any third party.
Custom Builds: Upon full payment, you receive ownership of the final website design as it appears on your Wix account. Kimmy Web Studio retains the right to display the work in our portfolio unless you request otherwise in writing.
Your Content: You retain ownership of all content, copy, images, and materials you provide to us. By submitting them, you grant Kimmy Web Studio a limited license to use that content solely for the purpose of completing your project.
6. Client Responsibilities
To ensure a smooth project experience, clients agree to:
— Provide all required content, materials, and approvals within agreed timelines
— Ensure all content provided is original, licensed, or otherwise legally permitted for use
— Respond to communication requests in a timely manner to avoid project delays
— Review and approve deliverables within the review period specified in your project agreement
Project delays caused by late content submissions or non-responsiveness may result in rescheduling or additional fees as outlined in your project agreement.
7. Prohibited Uses
When using this website or our services, you agree not to:
— Use the site for any unlawful purpose or in violation of any applicable laws
— Attempt to gain unauthorized access to any part of this website or its underlying systems
— Copy, scrape, or reproduce any content, designs, or code without written permission
— Use our templates or deliverables to create competing products for resale
— Misrepresent your identity or affiliation with any person or entity
— Transmit malicious code, spam, or any content that could harm our systems or reputation
8. Third-Party Platforms
All custom websites and templates are built on the Wix platform. Your use of Wix is governed by Wix's own Terms of Service and Privacy Policy. Kimmy Web Studio is not affiliated with or endorsed by Wix and is not responsible for any changes Wix makes to its platform, pricing, or features.
Links to third-party websites or tools on our site are provided for convenience only. We are not responsible for the content, accuracy, or practices of any third-party site.
9. Disclaimer of Warranties
This website and all services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount you paid to Kimmy Web Studio in the three (3) months preceding the claim.
